1. NAME OF ORGANISATION
The name of the organization shall be: The WESTCOAST MOTORCYCLE ASSOCIATION and shall be abbreviated WMA.
A Badge, which shall read WMA, will be made available to each member of every club or member that is a fully paid up member of the WMA.
All members are obligated, but not compelled, to wear the badge.
2. OBJECTIVES OF THE WMA
- The objectives of the Association shall be:
- To serve and unite the Bike Clubs and Groups in the West Coast.
- To impartially mediate in dispute between Bike Clubs, Groups or members
- To promote and improve the image of biking to the general public
- To implement safety measures at events for the benefit of all bikers and the public
- To co – ordinate an liaise with organizations or individuals that want to hold rallies or events for the purpose of fund raising
- To co – ordinate an annual calendar of dates for rallies or events held by members of the WMA and to publish all function dates for all motorcycle clubs in the West Coast, stipulating WMA dates
- To function as an organized body, not for gain, and to acquire registration as such
- To operate as a non racial, non political and non denominational body, which still reserves the right of admission
- To liaise as a body between international clubs, associations, unions, etc
3. MEMBERSHIP OF WMA
- Membership of this association shall be open to any Bike Club and/ or Business in the West Coast Region
- Associated membership shall be open to any company or organization with the vested interest in aiding and/ or promoting the biking community in general
- The representative of any such club at an WMA meeting shall make application for full and binding membership
- Individuals shall nominate a representative from a group with a minimum of five (5) bikers or from an organization as mentioned above, to make application for full and binding membership as a group to the WMA
- A Two / third majority vote shall decide on the acceptance of application
- Any club or represented group or organization which fails to meet obligation or requirements of this association shall be suspended or have its membership terminated
- Each club or represented group (except associated members) has the right to vote on all matters requiring a vote of the membership of the WMA
- Each club or represented group (except associated members) shall be under obligation to; regular attendance of meetings, prompt payment of fees, participation in association activities
- All members and associated members of the WMA shall be obligated to conduct themselves in such a manner as to reflect a favorable image of the WMA at all times
- Each club or represented group shall submit an update membership register to the WMA committee at the first meeting each year
4. APPLICATION PROCEDURE FOR MEMBERSHIP OF THE WMA
- Applicants shall follow the following procedure:
- Attend the first meeting to observe and receive an application form and constitution.
- Attend the second meeting to hand in application form, the full club list (with phone numbers and e-mail addresses) if joining as a club and a signed WMA constitution.
- The Registration Fee (R150.00) and Membership fees are to be paid to the WMA at the third meeting.
- The WMA Committee shall visit the new applicant in the month after the third meeting.
- If, during the aforementioned, the club, individual or Business miss one meeting, they need to re-apply to join.
5. MEMBERSHIP FEES OF THE WMA
- At the first WMA meeting of the year, each Club or represented group or organization shall pay an annual membership fee of
- R 150.00. Members that pay late will be fined R 10.00 per month until fees are paid.
- Membership fees to be paid in full not later than the April meeting of each year
- Membership fees not paid in full by the May meeting will result in termination of membership.
- New clubs / organizations joining must pay a registration fee of R100.00
- Membership fees paid to the WMA will be used to the benefit of the WMA affiliated clubs
- WMA is a non-profitable organization. All monies received by WMA will be returned to the WMA affiliated clubs, e.g. Fun day, etc
- Annual membership fees may only be amended at the AGM by a majority vote of the members present.
6. OBLIGATION OF MEMBERS OF THE WMA
- The obligation of each club or represented group shall be as follows:
- To abide by the regulations and guidelines as set out and agreed upon by the WMA
- To promote the good spirit and fellowship amongst all bikers
- To respect the safety and property of all fellow bikers and the general public
- To abide by the law and maintain a reasonable standard of behavior
- To support fellow members in the biking community
- Each WMA member shall be under the following obligations: regular attendance of meetings, prompt payment of fees and participation in WMA activities.
- All member Club Presidents are to make sure that all motorcycles and members in his / her club are in possession of a valid drivers and motorcycle license. The onus is on the President and the member
7. DISCIPLINE OF MEMBERS OF THE WMA
The failure of any club or represented group, or members of such club or represented group, to abide by the regulations and guidelines as set out and agreed upon by the WMA shall result in the following action:
- The immediate notification in writing to the club or group’s representative, concerning the club or group, or individual member(s) of such club or group’s disregard for regulations and/ or guidelines.
- Such notification shall request the following action to be taken depending on the nature and frequency of incidents:
- A formal apology to WMA by individual member(s), or club or group
- Denying entry to WMA sanctioned events, of individual clubs or group members or the entire club or group
- Suspension of club or group membership to the WMA
- Termination of club or group’s membership to the WMA
- Unruly behavior by members at a function will result in the WMA Committee approaching the member Club Presidents of these clubs and asking them to deal with their member / s in a disciplinary way. Feedback will be required from the President/ individual or Business concerned, in writing within 30 days.
8. TERMINATION OF MEMBERSHIP TO THE WMA
The termination of a club or group’s membership to the WMA, may only be decided by two / third majority vote taken at a legitimate meeting. This meeting shall be chaired by the acting Chairman or Vice-chairman and shall be attended by a minimum (two/third) off all clubs or groups that are fully paid up members of the WMA
9. COMMITTEE STRUCTURE OF THE WMA
- Chairman
- Vice-chairman
- Secretary
- Treasurer (When required)
- PRO (When required)
- Assistant Secretary (When required)
- Sub–committee (Consisting of various Presidents of WMA clubs) [When required]
10. MEETINGS OF THE WMA
WMA meetings shall be held as follows:
On each meeting the members will decide the date of the next meeting
11 .GM AND ELECTION OF WMA COMMITTEE
- The AGM shall be attended by a minimum of two/third of all members of the WMA
- The existing committee shall each submit a final report for the term of office
- The chairman shall read the list of nominations for the new committee
- Each nominated member shall leave the room when the WMA members decide, by taking a hand count or ballot, as to who is appointed
- The following sequence shall be followed: Vice-chairman, Treasurer, Secretary, PRO, Assistant Secretary and Chairman
- The existing Vice-chairman shall decide the vote should there be a split decision on the nomination for the Chairman
- The new Chairman shall decide the vote should there be a split decision on the nomination of any other committee member
- The new committee shall immediately take office once elections are completed.
12. TERM OF OFFICE OF THE WMA
- The WMA committee shall have re-elections once a year in February
- Any committee member, including the Chairman, may be relieved of office by calling an emergency meeting, which shall be attended and chaired by the Chairman / or Vice-chairman, as well as a minimum of two/third of all fully paid up members of the WMA
13. AMENDMENTS TO CONSTITUTION
This constitution may only be amended and adopted, if application is made in writing, for a SPECIAL meeting, at least two weeks before the fact, by two/third majority vote taken by a minimum of two/third of all current fully paid up members of the WMA.
14. RULES OF ORDER OF THE WMA
- The following agenda shall be adopted:
- Welcome by Chairman
- Attendance register
- Reports by Chairman, Vice-chairman, Treasurer, PRO, Secretary and Assistant secretary
- Matters arising from last minutes
- General discussions:
- The Chairman will be notified, before the commencement of the meeting, of any matter(s) that need to be discussed
- Each matter to be discussed shall be called by the chairman and an orderly debate held and controlled by the Chairman
- Update of calendar
- Announcement of venue for next meeting
- Close of meeting by Chairman
- The members of the WMA shall pursue all complaints, disputes or claims in accordance with the terms and conditions of the above said rules of procedures and agree to be bound by the decision thereof
- No disrespect to either the Chairman or members of the committee will be tolerated at any time.
15. INTERPRETATION
- Save where the context otherwise requires, singular words shall be deemed to import the plural and vice-versa and the masculine gender shall be deemed to include the feminine and vice-versa
- The word “member” could also be interpreted as meaning “club”.
16. DISBANDMENT
Upon the winding up of the WMA, any remaining assets, shall after satisfaction of the liabilities of the WMA, be given to such other organization, having as their objects, the development and uplifting of underprivileged communities and persons in the broader West Coast area, and which are authorized to collect contributions in terms of the fund-raising Act 107 of 1978, as may be decided upon by the members at the meeting at which it was decided to terminate the association.
17. GENERAL
- The onus rests on each member to abide by the Road Traffic Act.
- The WMA will exist in its own right, separately from its members.
- The WMA will be able to own property and other possessions.
- The WMA will be able to sue and be sued in its own name.
